What You Will Learn

Both the Obama Administration and legislators are proposing new provisions for generating renewable energy and siting new transmission lines. This seminar reviews traditional environmental laws like NEPA, the Endangered Species Act, and state land use and preservation laws as they impact new energy infrastructure in terms of the legal and policy implications of a smart grid and distributed electricity generation. Panelists discuss whether siting facilities to reduce greenhouse gas emissions will worsen local environmental impacts, and how project developers will need to mitigate the risk of litigation and other challenges to “green development.” Other topics include:

Recent and proposed changes in federal energy policies and agency actions that support more effective project siting

Updates on recent cases illustrating the issues raised by conflicts between projects and land use laws, such as with Nantucket Sound’s Cape Wind project

The status of initiatives in the areas of solar, wind, geothermal and hydrokinetic wave power

Practical tips for practitioners to consider when planning and siting new projects, and how to determine where development is appropriate
